Common law claim
A common law claim is a claim process through a court. The claim is brought against the party or parties who caused a person to be exposed to asbestos. These parties are known as the "defendants". A common law claim begins by filing a formal court document known as an "originating process". The originating process must be lodged within your lifetime to protect your entitlement to compensation. As long as you start a common law claim during your lifetime, your estate will still be able to continue with your claim if you die before the claim is finalised.

How long will a common law case take?
The majority of common law claims for mesothelioma are settled out of court within 3–6 months of the claim being lodged. If your prognosis is poor, or you suddenly become very unwell, the process can be sped up to try to ensure that your common law claim is resolved in your lifetime. Only a few cases actually proceed to a court trial.
What if I die before my claim is settled?
Many people diagnosed with mesothelioma worry that their claim won't be finalised before they die. The largest component of compensation is usually the general damages. Do I need a lawyer?
It is possible for you and sometimes your dependants to lodge a statutory claim directly with the authority in your state or territory. However, most people with mesothelioma prefer to use a lawyer to arrange all their claims.
The laws around Australia vary and can be complex. Some people may be entitled to bring a common law claim instead of, or in addition to, a statutory claim. Terus seperti itu setiap harinya. Hingga pada suatu hari ketika ia berjalan pulang dari kota ia melihat sesuatu yang menggelepar di atas salju. Setelah di dekatinya ternyata seekor burung bangau yang terjerat diperangkap sedang meronta-ronta. Yosaku segera melepaskan perangkat itu. Bangau itu sangat gembira, ia berputar-putar di atas kepala Yosaku beberapa kali sebelum terbang ke angkasa. Karena cuaca yang sangat dingin, sesampainya dirumah, Yosaku segera menyalakan tungku api dan menyiapkan makan malam. Saat itu terdengar suara ketukan pintu di luar rumah.
Ketika pintu dibuka, tampak seorang gadis yang cantik sedang berdiri di depan pintu. Kepalanya dipenuhi dengan salju. "Masuklah, nona pasti kedinginan, silahkan hangatkan badanmu dekat tungku," ujar Yosaku. "Nona mau pergi kemana sebenarnya ?", Tanya Yosaku. "Aku bermaksud mengunjungi temanku, tetapi karena salju turun dengan lebat, aku jadi tersesat." "Bolehkah aku menginap disini malam ini ?". "Boleh saja Nona, tapi aku ini orang miskin, tak punya kasur dan makanan." ,kata Yosaku. "Tidak apa-apa, aku hanya ingin diperbolehkan menginap". Kemudian gadis itu merapikan kamarnya dan memasak makanan yang enak.
Ketika terbangun keesokan harinya, gadis itu sudah menyiapkan nasi. Yosaku berpikir bahwa gadis itu akan segera pergi, ia merasa kesepian. Salju masih turun dengan lebatnya. "Tinggallah disini sampai salju reda." Setelah lima hari berlalu salju mereda. Gadis itu berkata kepada Yosaku, "Jadikan aku sebagai istrimu, dan biarkan aku tinggal terus di rumah ini." Yosaku merasa bahagia menerima permintaan itu. "Mulai hari ini panggillah aku Otsuru", ujar si gadis. Setelah menjadi Istri Yosaku, Otsuru mengerjakan pekerjaan rumah dengan sungguh-sungguh. Suatu hari, Otsuru meminta suaminya, Yosaku, membelikannya benang karena ia ingin menenun.
Otsuru mulai menenun. Ia berpesan kepada suaminya agar jangan sekali-kali mengintip ke dalam penyekat tempat Otsuru menenun. Setelah tiga hari berturut-turut menenun tanpa makan dan minum, Otsuru keluar. Kain tenunannya sudah selesai. "Ini tenunan ayanishiki. Kalau dibawa ke kota pasti akan terjual dengan harga mahal. Yosaku sangat senang karena kain tenunannya dibeli orang dengan harga yang cukup mahal. Sebelum pulang ia membeli bermacam-macam barang untuk dibawa pulang. "Berkat kamu, aku mendapatkan uang sebanyak ini, terima kasih istriku. Tetapi sebenarnya para saudagar di kota menginginkan kain seperti itu lebih banyak lagi. "Baiklah akan aku buatkan", ujar Otsuru. Kain itu selesai pada hari keempat setelah Otsuru menenun. Tetapi tampak Otsuru tidak sehat, dan tubuhnya menjadi kurus. Otsuru meminta suaminya untuk tidak memintanya menenun lagi.
Di kota, Sang Saudagar minta dibuatkan kain satu lagi untuk Kimono tuan Putri. Jika tidak ada maka Yosaku akan dipenggal lehernya. Hal itu diceritakan Yosaku pada istrinya. "Baiklah akan ku buatkan lagi, tetapi hanya satu helai ya", kata Otsuru.
Karena cemas dengan kondisi istrinya yang makin lemah dan kurus setiap habis menenun, Yosaku berkeinginan melihat ke dalam ruangan tenun. Tetapi ia sangat terkejut ketika yang dilihatnya di dalam ruang menenun, ternyata seekor bangau sedang mencabuti bulunya untuk ditenun menjadi kain. Sehingga badan bangau itu hampir gundul kehabisan bulu. Bangau itu akhirnya sadar dirinya sedang diperhatikan oleh Yosaku, bangau itu pun berubah wujud kembali menjadi Otsuru. "Akhirnya kau melihatnya juga", ujar Otsuru.
"Sebenarnya aku adalah seekor bangau yang dahulu pernah Kau tolong", untuk membalas budi aku berubah wujud menjadi manusia dan melakukan hal ini," ujar Otsuru. "Berarti sudah saatnya aku berpisah denganmu", lanjut Otsuru. "Maafkan aku, ku mohon jangan pergi," kata Yosaku. Otsuru akhirnya berubah kembali menjadi seekor bangau. Kemudian ia segera mengepakkan sayapnya terabng keluar dari rumah ke angkasa. Tinggallah Yosaku sendiri yang menyesali perbuatannya.
