Common law claim
A common law claim is a claim process through a court. The claim is brought against the party or parties who caused a person to be exposed to asbestos. These parties are known as the "defendants". A common law claim begins by filing a formal court document known as an "originating process". The originating process must be lodged within your lifetime to protect your entitlement to compensation. As long as you start a common law claim during your lifetime, your estate will still be able to continue with your claim if you die before the claim is finalised.
You need to speak with a lawyer experienced in asbestos-related compensation claims as soon as possible after your diagnosis. If you're too unwell to visit the lawyer in their office, they can visit you at home or in hospital to discuss the process and how it can be simplified for you and your family.

How long will a common law case take?
The majority of common law claims for mesothelioma are settled out of court within 3–6 months of the claim being lodged. If your prognosis is poor, or you suddenly become very unwell, the process can be sped up to try to ensure that your common law claim is resolved in your lifetime. Only a few cases actually proceed to a court trial.
What if I die before my claim is settled?
Many people diagnosed with mesothelioma worry that their claim won't be finalised before they die. The largest component of compensation is usually the general damages. So long as you start a common law claim in your lifetime, then your entitlement to general damages is protected, and your estate would be able to continue with your claim if you die before your claim is finalised.

How much does legal action cost?

Do I need a lawyer?
It is possible for you and sometimes your dependants to lodge a statutory claim directly with the authority in your state or territory. However, most people with mesothelioma prefer to use a lawyer to arrange all their claims.
The laws around Australia vary and can be complex. Some people may be entitled to bring a common law claim instead of, or in addition to, a statutory claim. It is vital to consult an expert asbestos lawyer before applying for statutory benefits to ensure you aren't excluded from also claiming common law compensation.

Advance care planning

LIHATLAH AKU DARI SURGA, GURUKU
Waktu itu aku kelas 5 SD. Sekolahanku dekat rumah, kompleks rumah tepatnya. Asyik tahu, kalo waktu istirahat tiba aku bisa melenggang pulang, bisa ngrecokin mama masak. Heehe. Pernah waktu itu, aku lupa nggak bawa PR, lalu aku pura-pura ijin sama Pak Guru ke toilet. Setelah keluar, aku langsung ngibrit lari ke gerbang belakang, pulang ambil PR di rumah. Haaha. Seumpama belum bikin PR, aku sempat-sempatin bikin PR kilat. Lalu balik lagi ke sekolah. Sampai kelas ngos-ngosan. Jadi nggak pernah ada tuh cerita nggak bawa PR. Siswa teladan bukan?
Sejak kelas 1 sampai kelas 6 aku termasuk siswa berprestasi loh di sekolah. Paling jelek itu aku dapat ranking 5 besar. Gimana? Kerenkan aku. Heehe. Pelajaran yang paling aku jago itu, Bahasa Inggris. Gimana enggak, kebanyakan saudaraku pada ngomong pakai bahasa bule ini, jadi aku rada kecipratan deh.
Ada seorang guru laki-laki yang masih aku ingat sampai sekarang. Beliau mengajar pelajaran Matematika dan IPA. Buatku itu adalah dua pelajaran yang aduhai menyebalkan sekali. Aku jarang dapat nilai 90 atau 100, mentok-mentoknya juga 85. Ecieee, sorry ya aku anak yang perfect dulu. Haaha. Maunya apa-apa dapat 100. Pelajaran menggambar pun kalo bisa dapet nilai 100, tapi nggak tahu kutukan apa. Guru Seni & Budaya selalu memberi nilai 80 ke semua siswa. Entah itu gambarannya bagus atau antah berantah. Guru yang aneh.
Tapi Pak Guruku yang satu ini nggak aneh, namanya Pak Marsono. Beliau separuh baya, badannya tinggi, gemuk, perutnya rada buncit gitu, punya kumis kayak Hitler dan yang paling aku inget, rambutnya rada botak di ubun-ubun. Heehe. He’s my favorite teacher. Kenapa aku bisa memfavoritkan guru kayak gitu? Soalnya beliau itu lucu, trus kalo ketawa kumisnya bisa goyang-goyang gitu. Aku dianggap udah kayak anaknya sendiri. Aku juga sering main ke rumahnya. Belajar matematika, pokoknya sampai aku mudeng.
Tiba hari kelulusan sekolah, begitu aku dapat pengumuman aku langsung berlari mencari Pak Marsono bersama teman-temanku.
“Pak kami lulus!!!!!” teriak kami sambil jingkrak-jingkrak khas anak kecil.
“Iya, nduk. Selamat ya. Besok kalo kamu nikah jangan lupa undang bapak ya” kata beliau sambil menepuk bahuku sembari tersenyum.
“Ngeek? Bapak ini gimana e, wong baru lulus SD kok udah disuruh nikah” diikuti sorakan teman-temanku yang ada dibelakang.
“Wwuuuuuuu…..” kami semua tertawa terbahak-bahak.
Peristiwa itu takkan pernah kulupa hingga kini. Setelah beberapa tahun berlalu. Aku telah lulus sarjana muda di salah satu perguruan tinggi di Yogyakarta dan tunanganku mengajakku menikah. Aku telah menulis semua daftar tamu undangan, termasuk beliau Pak Marsono. Tapi satu undangan ini, hanya akan menjadi usang.
Ketika aku datang lagi ke rumah beliau setelah beberapa tahun tidak mengunjungi rumah itu, ada sesuatu yang menggoyahkan hatiku. Bahwa Pak Marsono telah meninggal dunia setahun yang lalu. Seketika mataku berkaca-kaca, undangan pernikahanku ini tak lagi dapat menjadi berita baik baginya. Namun ini berita pilu bagiku.
Disini, sore ini di depan nisanmu. Aku memperkenalkan suamiku, Pak. Aku telah menikah. Rangkaian bunga indah ini untukmu. Selamat jalan Pak, terima kasih engkau dulu telah membimbingku. Maafkan aku, jika aku lama tak menemuimu.
