Common law claim
A common law claim is a claim process through a court. The claim is brought against the party or parties who caused a person to be exposed to asbestos. These parties are known as the "defendants". A common law claim begins by filing a formal court document known as an "originating process". The originating process must be lodged within your lifetime to protect your entitlement to compensation. As long as you start a common law claim during your lifetime, your estate will still be able to continue with your claim if you die before the claim is finalised.

How long will a common law case take?
The majority of common law claims for mesothelioma are settled out of court within 3–6 months of the claim being lodged. If your prognosis is poor, or you suddenly become very unwell, the process can be sped up to try to ensure that your common law claim is resolved in your lifetime. Only a few cases actually proceed to a court trial.
What if I die before my claim is settled?

Do I need a lawyer?
It is possible for you and sometimes your dependants to lodge a statutory claim directly with the authority in your state or territory. However, most people with mesothelioma prefer to use a lawyer to arrange all their claims.
The laws around Australia vary and can be complex. Some people may be entitled to bring a common law claim instead of, or in addition to, a statutory claim. Alkisah, Di pantai barat Semenanjung Melayu, terdapat sebuah kerajaan bernama Negeri
Bintan. Waktu itu ada seorang anak lakik-laki bernama Hang Tuah. Ia
seorang anak yang rajin dan pemberani serta sering membantu orangtuanya
mencari kayu di hutan. Hang Tuah mempunyai empat orang kawan, yaitu Hang
Jebat, Hang Lekir, Hang Lekiu dan Hang Kesturi. Ketika menginjak
remaja, mereka bermain bersama ke laut. Mereka ingin menjadi pelaut yang
ulung dan bisa membawa kapal ke negeri-negeri yang jauh.
Suatu hari, mereka naik perahu sampai ke
tengah laut. “Hei lihat, ada tiga buah kapal!” seru Hang Tuah kepada
teman-temannya. Ketiga kapal itu masih berada
di kejauhan, sehingga mereka belum melihat jelas tanda-tandanya. Ketiga
kapal itu semakin mendekat. “Lihat bendera itu! Bendera kapal perompak!
“Kita lawan mereka sampai titik darah penghabisan!” teriak Hang
Kesturi. Kapal perompak semakin mendekati perahu Hang Tuah dan
teman-temannya. “Ayo kita cari pulau untuk mendarat. Di daratan kita
lebih leluasa bertempur!” kata Hang Tuah mengatur siasat. Sesampainya di
darat Hang Tuah mengatur siasat. Pertempuran antara Hang Tuah dan
teman-temannya melawan perompak berlangsung sengit. Hang Tuah menyerang
kepala perompak yang berbadan tinggi besar dengan keris pusakanya. “Hai
anak kecil, menyerahlah… Ayo letakkan pisau dapurmu!” Mendengar
kata-kata tersebut Hang Tuah sangat tersinggung. Lalu ia melompat dengan
gesit dan menikam sang kepala perompak. Kepala perompak pun langsung
tewas. Dalam waktu singkat Hang Tuah dan teman-temannya berhasil
melumpuhkan kawanan perompak. Mereka berhasil menawan 5 orang perompak.
Beberapa perompak berhasil meloloskan diri dengan kapalnya.
Kemudian Hang Tuah dan teman-temannya menghadap Sultan Bintan sambil membawa
tawanan mereka. Karena keberanian dan kemampuannya, Hang Tuah dan
teman-temannya diberi pangkat dalam laskar kerajaan. Beberapa tahun
kemudian, Hang Tuah diangkat menjadi pimpinan armada laut. Sejak menjadi
pimpinan armada laut, negeri Bintan menjadi kokoh dan makmur. Tidak ada
negeri yang berani menyerang negeri Bintan. Beberapa waktu kemudian,
Sultan Bintan ingin mempersunting puteri Majapahit di Pulau Jawa. “Aku
ingin disiapkan armada untuk perjalanan ke Majapahit,” kata Sultan
kepada Hang Tuah. Hang Tuah segera membentuk sebuah armada tangguh.
Setelah semuanya siap, Sultan dan rombongannya segera naik ke kapal
menuju ke kota Tuban yang dahulunya merupakan pelabuhan utama milik
Majapahit. Perjalanan tidak menemui hambatan sama sekali. Pesta
perkawinan Sultan berlangsung dengan meriah dan aman.
Setelah selesai perhelatan perkawinan,
Sultan Bintan dan permaisurinya kembali ke Malaka. Hang Tuah diangkat
menjadi Laksamana. Ia memimpin armada seluruh kerajaan. Tetapi hal ini
tidak berlangsung lama karena para perwira istana menjadi iri hati. Para
perwira istana menghasut Sultan. Mereka mengatakan bahwa Hang
Tuah hanya bisa berfoya-foya, bergelimang dalam kemewahan dan
menghamburkan uang negara. Akhirnya Sultan termakan hasutan mereka.
Hang Tuah dan Hang Jebat di berhentikan. Bahkan para perwira istana
mengadu domba Hang Tuah dan Hang Jebat. Mereka menuduh Hang Jebat akan
memberontak. Han Tuah terkejut mendengar berita tersebut. Ia lalu
mendatangi Hang Jebat dan mencoba menasehatinya. Tetapi rupanya siasat
adu domba oleh para perwira kerajaan berhasil. Hang Jebat dan Hang Tuah
bertengkar dan akhirnya berkelahi. Naas bagi Hang Jebat. Ia tewas
ditangan Hang Tuah. Hang Tuah sangat menyesal. Tapi bagi Sultan, Hang
Tuah dianggap pahlawan karena berhasil membunuh seorang pemberontak.
“Kau kuangkat kembali menjadi laksamana”, kata Sultan pada Hang Tuah.
Sejak saat itu Hang Tuah kembali memimpin armada laut kerajaan.
Suatu hari, Hang Tuah mendapatkan tugas
ke negeri India untuk membangun persahabatan antara Negeri Bintan dan
India. Hang Tuah di uji kesaktiannya oleh Raja India untuk menaklukkan
kuda liar. Ujian itu berhasil dilalui Hang Tuah. Raja India dan para
perwiranya sangat kagum. Setelah pulang dari India, Hang Tuah menerima
tugas ke Cina. Kaisarnya bernama Khan. Dalam kerajaan itu tak seorang
pun boleh memandang langsung muka sang kaisar. Ketika di jamu makan
malam oleh Kaisar, Hang Tuah minta disediakan sayur kangkung. Ia duduk
di depan Kaisar Khan. Pada waktu makan, Hang Tuah mendongak untuk
memasukkan sayur kangkung ke mulutnya. Dengan demikian ia dapat melihat
wajah kaisar. Para perwira kaisar marah dan hendak menangkap Hang Tuah,
namun Kiasar Khan mencegahnya karena ia sangat kagum dengan kecerdikan
Hang Tuah.
Beberapa tugas kenegaraan lainnya berhasil dilaksanakan dengan baik oleh Hang
Tuah. Hingga pada suatu saat ia mendapat tugas menghadang armada dari
barat yang dipimpin seorang admiral yang bernama D Almeida. Armada ini
sangat kuat. Hang Tuah dan pasukannya segera menghadang. Pertempuran
sengit segera terjadi. Saat itulah Hang Tuah gugur membela tanah airnya.
Ia tewas tertembus peluru sang admiral.
Sejak saat itu, nama Hang Tuah menjadi terkenal sebagai pelaut ulung, laksamana yang gagah berani dan menjadi pahlawan di Indonesia dan di Malaysia. Sebagai bentuk penghormatan, salah satu dari kapal perang Indonesia diberi nama KRI Hang Tuah. Semoga nama itu membawa ‘tuah’ yang artinya adalah berkah.
Sejak saat itu, nama Hang Tuah menjadi terkenal sebagai pelaut ulung, laksamana yang gagah berani dan menjadi pahlawan di Indonesia dan di Malaysia. Sebagai bentuk penghormatan, salah satu dari kapal perang Indonesia diberi nama KRI Hang Tuah. Semoga nama itu membawa ‘tuah’ yang artinya adalah berkah.
